§ 1 Scope and provider information
(1) The following Terms and Conditions apply to all contracts that you conclude with us as a provider via our online shop at [www.andys-liquors.de].

§ 2 Protection of minors
(1) In accordance with § 9 of the German Youth Protection Act, alcoholic products may only be sold and shipped to persons who have reached the age of 18.
(2) By submitting your order, you confirm that you are at least 18 years of age and that all information provided regarding your identity and delivery address is true.
(3) You also undertake to ensure that the delivery is accepted exclusively by you personally or by an adult authorized by you to accept it.
(4) We reserve the right to verify your age (e.g., by asking the delivery person for proof of age or by other appropriate means). If it subsequently transpires that the order was placed by a minor, we will revoke the contract as a precautionary measure in accordance with § 109 BGB (German Civil Code).
§ 3 Subject matter of the contract
The subject matter of the contract is the sale of alcoholic beverages and other products via our online shop.
§ 4 Conclusion of contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
(2) By submitting your order via the “Place order” button, you are making a binding offer to conclude a purchase contract.
(3) Confirmation of receipt of the order is sent automatically by email and does not constitute acceptance. The purchase contract is only concluded with our express declaration of acceptance (e.g. by shipping confirmation) or delivery of the goods.
§ 5 Prices and shipping costs
(1) All prices are quoted in euros and include the applicable German value-added tax (VAT). For deliveries to Switzerland or other third countries outside the EU, no German VAT is charged—any import sales tax or local taxes in the destination country are the responsibility of the buyer.
(2) Shipping costs are shown separately during the ordering process. For orders totaling €50.00 or more, we offer free shipping within Germany.
(3) Shipping costs always apply for deliveries to Switzerland or other third countries. Any customs duties, import duties, and foreign taxes are the responsibility of the buyer.
§ 6 Delivery
(1) Delivery is available within Germany, to Switzerland, and to other countries via standard shipping (non-trackable and suitable for lightweight items without glass, e.g., individual cotton bags) or DHL parcel service (trackable and insured up to €500).
(2) Unless otherwise stated, the delivery time is 2–4 business days from receipt of payment. For deliveries to Switzerland, the delivery time is approximately 5–8 business days, depending on customs processing.
(3) Risk passes to you upon delivery of the goods. If the delivery is accepted by a person designated by you, this also constitutes delivery.
(4) Please note that not all products can be shipped to Switzerland or other third countries. Therefore, these products are not available for selection in the respective markets and are disabled.
§ 7 Refusal of Acceptance & Return Due to Undeliverability
If the customer or a recipient designated by the customer refuses to accept the delivery without having effectively revoked the contract beforehand, or if a shipment is returned to us for reasons for which the customer is responsible (e.g., undeliverable address, failure to collect), we reserve the right to retain the shipping costs incurred as a result.
After receipt of the return shipment, the customer has 14 days to contact us regarding a new delivery or refund.
If we do not receive any response within this period, we will refund the value of the order via the original payment method.
It is not necessary for us to contact the customer separately; the responsibility for contacting us lies with the customer.
Further shipping or return costs will not be refunded in this case.
§ 8 Terms of payment
The payment methods available and displayed at checkout are available to you.
§ 9 Retention of title
The goods remain our property until full payment has been received.
§ 10 Right of withdrawal
The statutory right of withdrawal applies in accordance with the provisions of the German Civil Code (BGB) and the EU Consumer Rights Directive.
Consumers have a statutory right of withdrawal.

§ 11 Warranty
The statutory warranty rights in accordance with §§ 434 ff. BGB apply.

§ 12 Liability
(1) Your claims for damages are excluded. This does not apply to claims for damages arising from injury to life, limb, or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by the provider, its legal representatives, or vicarious agents.
(2) In the event of a breach of essential contractual obligations, we shall only be liable for foreseeable damage typical for this type of contract if this was caused by simple negligence, unless you have claims for damages arising from injury to life, limb, or health.
(3) The limitations in paragraphs 1 and 2 also apply in favor of the provider's legal representatives and vicarious agents if claims are asserted directly against them.
(4) The provisions of the Product Liability Act remain unaffected.
§ 13 Data protection

§ 14 Dispute resolution
The EU Commission provides a platform for online dispute resolution:

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 15 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction is Albstadt, provided that you are a merchant, a legal entity under public law, or a special fund under public law.
(3) Should individual provisions of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
(4) These Terms and Conditions are binding in their German-language version. Translations into other languages are provided for informational purposes only. In the event of any discrepancy between the German version and a translation, the German version shall prevail.
